Wheel Swap is operated by Mikheil Chkhvirkia, an individual entrepreneur registered in Georgia, identification number 62005029525, registered address Beliashvili St. 70b, Tbilisi, Georgia ("we", "us", "the Provider"). You can reach us at mishikochkhvirkia@gmail.com or on +995 597 81 58 15.
These Terms govern your use of wheel-swap.com and any application, bot or interface we operate ("the Service").
2Definitions
- Generation — one attempt to produce an edited image from the material you supply.
- Credit — the unit consumed by one Generation. Different edit types may consume a different number of Credits, stated before you confirm.
- Result — the image the Service returns.
- Plan — a free allowance, a one-time Credit pack, or a recurring subscription.
3Eligibility and your account
You must be at least 16 years old to create an account. If you use the Service for a business, you confirm you are authorised to bind that business.
You need an account to start a Generation, including free ones. Keep your credentials secure; you are responsible for activity under your account until you tell us it is compromised. We may require verification of your email address before granting a free allowance.
4What the Service does, and what it does not
You supply a photograph and, for most edit types, a reference photograph of a part. The Service produces an edited version of your photograph. It is a visual preview only.
No fitment guarantee. A Result does not confirm that a part physically fits your vehicle. Diameter, width, offset, bolt pattern, centre bore, brake clearance, load rating and legal compliance are not checked and cannot be inferred from an image. Verify fitment with a qualified professional before purchasing anything.
Automated output varies. Results are produced by automated image models and may contain visual inaccuracies, wrong detail, or artefacts. The same request made twice will not produce identical images. Do not rely on a Result as the sole basis for a purchase.
Output quality follows input quality. A dark, blurred or cropped photograph produces a poor Result. We publish guidance on what works, and following it is the single biggest thing you can do to get a usable image.
When a Credit is consumed. A Credit is consumed when a Generation completes and a Result is delivered to you, whether or not you are satisfied with how it looks. Dissatisfaction with the appearance of a Result is not by itself a ground for a refund — see the Refunds policy. Where a Generation fails technically, or is rejected by our automatic quality check before you see it, the Credit is returned to your balance automatically.
5The material you upload
You confirm that for every image you upload, you either own it or hold the rights necessary to have it processed by us, and that uploading it does not infringe anyone's rights.
You must not upload material that is unlawful; that depicts identifiable people without their consent; that infringes copyright, trademark or design rights; or that is intended to deceive, defraud or defame.
You grant us a limited, non-exclusive, revocable licence to store, transmit and process your uploaded images solely to produce Results for you, and to transmit them to the image-processing providers listed in the Privacy Policy. That licence ends when the image is deleted under the retention rules. We do not use your images to train models, and we do not license them to anyone else.
6Ownership of Results, trademarks and non-affiliation
As between you and us, you own the Results generated from your material and may use them for any lawful purpose, including commercially. We claim no ownership. We may retain Results in your account so you can access them, as described in the Privacy Policy.
We are not affiliated with any vehicle or parts manufacturer. Vehicle marques, model names, wheel brands and part designs that appear in your images or Results are the property of their respective owners. Their appearance is a consequence of the photographs you supply and does not imply that any manufacturer, distributor or retailer endorses, sponsors, licenses or is connected with this Service in any way.
Owning a Result is not the same as owning rights in what it depicts. If you supply a photograph taken by someone else — a marketplace listing, a catalogue image, a manufacturer's press photo — the copyright in that photograph remains theirs, and using the Result commercially may still require their permission. You are responsible for clearing third-party rights in anything you publish.
7Plans, Credits and payment
Prices are displayed before purchase, in Georgian lari unless another currency is shown. Payments are processed by our payment provider; we never receive or store your full card number or security code.
- Free allowance — granted once per verified account. It may be changed or withdrawn at any time and has no cash value.
- Credit packs — a one-time purchase. Credits are added on payment confirmation and do not expire.
- Subscriptions — a recurring charge on the cycle shown at checkout, governed by the Recurring Payments terms, which form part of these Terms.
Included Credits on a subscription reset at the start of each cycle and do not roll over unless we state otherwise. Where a plan permits usage beyond its included allowance, that overage is charged only after you have expressly accepted it.
You are responsible for any taxes applicable to you. Where we are required to charge Georgian VAT, prices are stated inclusive unless indicated otherwise.
8Acceptable use
You must not: use the Service to create misleading depictions of real people, vehicles or businesses presented as genuine; attempt to bypass Credit limits, rate limits or payment, including by creating multiple accounts to claim the free allowance more than once; automate access other than through an interface we provide for that purpose; resell Generations without our written agreement; reverse engineer, decompile or attempt to extract the models or prompts behind the Service; scrape the Service or its content; or attempt to disrupt, probe or overload it.
Where you publish a Result, you must not present it as an unedited photograph of a vehicle in a sale listing, an insurance claim, or any other context where a viewer would reasonably take it for an unmodified picture of the real thing.
9Availability and third-party dependencies
The Service depends on third parties, including hosting, payment and image-processing providers. We do not guarantee uninterrupted availability and may suspend the Service for maintenance, security or provider failure. Where a Generation fails for a technical reason attributable to us or our providers, the Credits are returned automatically.
10Suspension and termination
We may suspend or close an account that breaches these Terms, that we reasonably believe is being used for fraud or payment abuse, or where required by law. Where practical we will tell you why and give you an opportunity to respond.
You may close your account at any time. Closing an account cancels any active subscription at the end of the paid cycle and forfeits unused Credits, except where a refund is due under the Refunds policy.
11Intellectual property in the Service
The Service, its interface, text and branding remain our property or that of our licensors. Nothing in these Terms transfers those rights to you.
12Limitation of liability
Nothing in these Terms excludes liability that cannot be excluded under Georgian law, including liability for death or personal injury caused by negligence, or for fraud.
Subject to that, and to the fullest extent permitted by law:
- We are not liable for any purchasing decision you make in reliance on a Result, including the cost of parts bought that do not fit, are not as expected, or cannot lawfully be used.
- We are not liable for indirect or consequential loss, loss of profit, loss of business, loss of goodwill, or loss of data.
- Our total aggregate liability arising out of or in connection with the Service in any twelve-month period is limited to the greater of the amount you paid us in that period, or 100 GEL.
The Service is provided on an "as is" and "as available" basis. We do not warrant that Results will be accurate, complete or fit for any particular purpose.
13Your indemnity
You will indemnify us against claims, losses and reasonable costs arising from material you uploaded in breach of §5, or from your use of a Result in breach of these Terms or of law.
14Changes to these Terms
We may update these Terms. For changes that materially affect your rights or the price of an active subscription, we will give at least 14 days' notice by email before they take effect, and you may cancel before then without penalty. Continued use after the effective date means you accept the change. The version applicable to a purchase is the one displayed at the time of that purchase.
15Governing law and disputes
These Terms are governed by the law of Georgia. We will try to resolve any dispute with you directly — write to us first, and we will respond within 14 days. If we cannot resolve it, the dispute is subject to the exclusive jurisdiction of the courts of Tbilisi, Georgia.
If you are a consumer resident in the European Union or the United Kingdom, this clause does not deprive you of the protection of mandatory consumer-protection rules of your country of residence, or of your right to bring proceedings there.
16General
If any clause is held invalid, the rest remains in force. Our failure to enforce a right is not a waiver of it. You may not transfer your rights under these Terms without our consent.
